i want to buy a house in tamil nadu the house is own by an individual from 50 years he has become member of a housing society and plot allated to him he and the society both agree to build a house and it was handed over to the owner and he paid monthly installment and cleared the loan noc is obtained from the society he has a wife and three children the children objecting me not to buy the property pl advise

As the house is self acquired of the owner, it can definitely be sold by him without obtaining the NOC of his children and wife but it shall be morally better to get the consent of all concerned otherwise bitter relationship is imminent.

The seller seems to be the absolute owner of the property. There may be some internal family problem/dispute. BUT THAT DOES NOT GIVE HIS CHILDREN ANY RIGHT TO OBJECT. In such a situation, even if approached, the said children will not give their NOC.

LEGALLY,THEIR NOC IS NOT AT ALL REQUIRED. Therefore, there is no reason why the property should not be purchased, just because the children are objecting.

The house can be purchased without the NOC of the children or wife under the given facts.
