Can an executive decision over rule a court decision?

(Querist) 20 May 2012 This query is : Resolved 
CAT,kolkata ordered promotion from a back date with cosequential financial and service benefits to an employee.But DEPARTMENT has ordered promotion as per same CAT decision without providing consequential financial benefits. Please let me know whether such executive decision can over rule a CAT decision with any further order from a higher Court.

No, they cannot go against CAT order.

CAT orders have to be complied with by the department

no they have to obey the order otherwise according to law they can can challenge the order.

but they have to obey till the set aside of that order.
