Can i file a bmc complaint when court case is going on rented house

(Querist) 28 March 2014 This query is : Resolved 
This is a rented home evac case and i am defendant & owner is plaintiff.
The building is deteriorating and small slabs are falling and recently a decent size one fall on ground floor.
Can i complaint in BMC & firebridge for the same incident when the matter is in court for evac? Or instead i need to put this in front of court?
