Can i file a case in higher court against petitioners for a frivolous case with evidence

(Querist) 22 February 2013 This query is : Resolved
Sir,

My tenants files a frivolous suit against me. That too by forging my signatures in a civil suit. i didnt not prefer filing a criminal case as i did not possess any evidence.

by the help of RTI i gathered more than enough evidence to prove that a frivolous case was filed by petitioners against me and thereby misleading the hon'ble court.

An appeal by me against the decree is reserved for judgment, what are the options available for me to act against the petitioners for the above frivolous case and is it good to file a private case or lodge a complaint in the concerned P.S for forgery please help.

Thanks

You have many options like filing a complaint under section 340 of Criminal procedure code in the same court which shall get lodged police complaint against such accused person who make forgery against you as his is also a forgery against the court.

Thank you Sirs for your valuable advice.

Of late i gathered some more information by which the signatures of my mother and father are forged too. My mother is not party to the suit but my father is.

Shall i file 3 separate cases or club all the three in one complaint. which is the most effective.

What will be the implications and punishment of such complaint. He is a govt servant.

Thank you Sirs.
