can NOC to accussed be granted without otherside say?

Hi All,
I have filed a criminal complaint with Magistrate Court at Kalyan agaist one person under section 211 & 499 of IPC, the said person has moved an application for getting NOC for application for Passport on false grounds, and the actual grounds as per my knowledge is that he has applied for a dependent visa in Canada, can a magistrate grant him NOC without hearing the complainants side? and if the magistrate does that what is remedy as the accused if he flees out of the countery it will be very difficult to bring him back and in that case the complaint will have no use.
As I can not spend money due to financial crises, I am seeking experts view from this forum.
I would like to share one more thing with you all that, I have filed PIL against the Maharashtra State Human Rights Commission to know more one can type Pushkar Damle Human Rights in google search bar you will get the details of the said PIL and further anybody is interested I can give all the relavant documents for study.
