namaste,
my mother was duped by some people in the pretext of helping her to sell her property asking her to give a Power of Attorney so that they can help her find a good real estate buyer. But instead they made her sign the documents of AGPA cum sale deed with possession in the year 2007 but never took any money from them. Now we have the Original Document with us ... Can we sell the property ? or we have to file a Civil case ?

Dear anonymous queriest, AGPA means Agreement cum General power of Attorney. then how sale deed? As per your query, the registration was done in the year 2007 without taking money why keep silent till date? consult an experienced advocate in property matters of your area for further guidance.

If no sale done or registered you can sell being the owner of the property. Rest of your queries can be better advised by local lawyer after perusal of the cited documents and the contents there in. When did you notice such a transaction and why did u keep quite?

My mother noticed it in the year of 2010 and approached a local lawyer by the name AS Rao ... Instead of filing a law suit he advised her to approach the Registrar through him for cancellation of such AGPA... And gave a paper Advertisement in the Year 2012. Now I came to know that all her efforts were vain... As the lawyer did not follow the path of filing a civil suit.

The property is validly transferred by the Attorney appointed by the executant. You are hopelessly late consequently barred by limitation.
