Cancellation of will deed

My mother owned property. which was my father's money. and mother died on 10february 2016.and earliear she made a will of property which was 26acares in sub register office 2009.without my presence.can i file.it as suit partition

She does not need anyone's presence or consent to write her WILL.

It appears that the proeprty is standing in the name of your mother even if it was purchased by your father's money.
If that is so then she can lawfully bequeath the property by Will to anyone of her choice.

The property is in the name of your mother.

Your mother can sell / gift / mortgage / bequeath her property, no consent of son / daughter needed.
