Car parking in flats

(Querist) 15 February 2016 This query is : Resolved
We are residing in a flat at Trichy. Only 50% of the flats are having car parking slots and others are parking their vehicles in common area only. Committee Members of Flat Owners Association are telling that only owners can park their vehicles in the common area and the tenants who don't have car parking slots should take away their vehicles from the apartment.

Kindly advise whether it is correct.

HI
Absolutely discriminatory.
Parking is a must for each and every flat.
moreover, flat owner association cannot discriminate between tenant and owner.
if your land lord has a car parking space, the same should be mandatory for the tenant also.

Lodge complaint with the registrar of societies.

In case of need proceed to take stay for such discriminating approach.

If a owner is allowed to park his car in common area, a tenant who has been lawfully occupying his flat can not be denied the same facility. As suggested by Mr. Goyal you can approach the Registrar of societies of your area with whom the Owners' welfare society is registered for redressal of your grievance. Before going to the Registrar, you should ask your house owner to take up the matter in shape of writing to create a documentary evidence of such discriminatory approach.
