Cheque bouncing action

One business man owe me some money back in March 2011,he has given me cheque and they bounced, due to good relations I have not taken any action as he has requested me that he will be clearing dues. against those cheques he has given me some cheques and asked me to place one of these for clearance and this is bounced again.now I am fed up and want to take action, pls let me know what to do.

Send a legal notice to the drawer of the cheque to refund your money,failing which you can file a case U/Sec.138 N.I.Act in Judicial Magistrate Court.
On the other hand if it is time barred by the provision of N.I. Act then you can lodge a diary to the Police and file a Criminal Case under sec.420.120B and 406 IPC. You can also file a Money Recovery Suit in Civil Court.

Thank you all.my further query is if there is need to take action as suggested by you, is anyone from you is based in pune.so that I can take action if he did not heed to my demand in my meeting with him planned tomorrow.
