Cheque thieved by accused

cheque was thieved from complainant by the Accused while cheque case is pending before the magistrate, whether case can proceed further with a xerox copy of the cheque?

IF YOU HAVE PRIDUCED DULY VERIFIED BY COURT/SUPRITENDANT CHEQUE IN SAID MATTER YOU CAN ADDUCE SECONDARY EVIDENCE WITH THE PERMISSION OF COURT.

I think you have to file separate police complaint of theft.

Definitely a specific complaint of Stealing the cheque from your possession by the accused is to be made and a FIR is required to be lodged and in that case only Court can allow the production of secondary evidence.

File a seperate complaint for theft of cheque, you can file an application along with the FIR for proceeding the case of N I Act further.
