Dear Sir,
kindly share your expert veiw that wife side is making plan to extort money in name of two children. children's eductaion is hampering in back more than one year.
husband wants to file child custody petition before the court for safe of education and he does not want to file diovirce for time being because bail in 498a is in pending.
kindly suggest that husbnad can file child custody petition only in this time.

Child custody petition can be filed at this time , there is no hindrance.
Filing of divorce suit does not have any bearing in getting bail especially if the plea of the husband not to take back his wife.

If you are so interested about the education of your children, your efforts done prior to the filing of desired petition in this regard shall play a vital role. Have you ever visited the school of your children, have you even paid their fee, have you ever provided any other means for their proper education, feeding, happiness and so on?
If yes only then file such petition otherwise pay the maintenance allowance to them as per their specific requirement as decided by court.

Dear Raj KUmar Sir,
husbnad attemted in several times through uncle, father and other relative to give children for continue the education in same school but she and her loved ones denied to give the children.
sir, i just want to take your veiw that what type of strategy to be taken from husbnad side so that custody can easily be given. kindly note that husbnad is not able to go to the place of her parent because anticipatory bail is in pending in session court in back eight month. if he goes than arrest must be done. she is always making influence to children to say against thier papa.
kindly suggest in this circumstances.
