Common passage

(Querist) 20 November 2013 This query is : Resolved 
we stay at an small outhouse with a common passage of abt 3 feet.The common passage is shared by 2 property holders all these years including ourself.The fron portion of d property is sold by the owner and the buyer has started construction and claims that he wants to use d common passage for his servents,this despite he having a vast space available in the front place itself.Can I contest in d court to fight for our privacy of the common passage.The buyer has got an area of around 4500 sq feet in d front and is harassing us that he wants his employees to use our common passage as he is making an office also in his property...plz help

are you owner of the outhouse? if one of property holders has sold his property th buyer would be entitled to use common passage . the passage is for benefit of all property holders and you cannot claim exclusive right for said passage

You can approach court for stay in case any one obstructs the common passage.

If the action of the new buyer obstructs the ingress and egress facilities to your property, you may seek the help o court of law.
