The Co. issues NCDs @ 11.5% interest payable at the interval of 5 months. The Co. comes up with ;a letter stating that due to fire at works, they r facing financial crunch and would like to extend investment for another one year and assures that interest will be paid regularly. No interest right from the date of investment paid. Some holders moved HC and the Co. got the order of Scheme of Arrangement. The case is, before Co. going into litigation, Demand note for refund was sent and the holders claim that Co. was holding NCD money onbl as a trustee and therefore trustees should be held liable as per S. 56 of Co. Act. There are contrary verdicts in the Appeal. Please guide.

What is the relief to an employee of a Pvt. Ltd. Co. who is sacked without assigning any reason for the Termination of his service. Can the employee hold the co. or its Directors resonsible for the Termination. Can he claim compensation for damages and the mental tourture caused to him. Pls advice. The company is regd. in mUmbai. Will require a lawyer in this behalf so requesting you all to advice accordingly.
