Compensation for inconvenience caused by services.

Dear sir, i have a share trading account in Reliance Money. I am not satisfied with the services of Reliance MOney, they usually deduct the amount from my trading account, when i complain for that they take time to resolved the complain more than one month after making lot of phone calls, i have spend more than Rs500 in making calls & waist my time about 5 hours in conversation with the customer care.

I have faced such type of problem many times, now i am fedup with the services of Reliance MOney i am planning to close the account of Reliance Money, but i want some compensation for the inconveinced caused by the reliance money.
Now i want to know :
1.Can i claim for compensation? if yes for what amount.

2.What is the process for claiming compensation?

As Vishal suggested there are some matters which a lawyer is not in a position to give the opinion. As your question mooted is what is the compenstion and what is the procedure. It is simple the procedure. But about compensation what decision the experts gives to you. So better meet a lawyer of who is familiar with CF works. But one thing you can assure you can approach the CF for difficieny of servioce.

2) First issue a legal notice ... if the notice is not complied with then you can file complaint before the Consumer Forum

From ur question it is clear that there is deficiency of service from the reliance money, so u can file consumer case and u can claim the expenses whatever u have made but u have to show the documents regarding the expenses u made.

Banking ombudsman has no jurisdiction on share trading service providers.

Dear friend,
from your problem, it is clear that Reliance money is something which is engaged in the business of share trading services, and you have been sufferred some loss by having no fault of yours, and the fault is on part of the trader.

So, the remedy is, firstly to file a complaint before SEBI. and secondly, to file a consumer complaint before the district consumer forum.
For filing both of the complaints you may approach a lawyer residing in your area, whbo is familiar with the consumer forum work, and better if he is familiar with the Stock Market also.

You can validly file a case in the Consumer Forum for deficiency in service as well as unfair trade practice on the part of Reliance Money. But remember to claim Compensation you will have to prove fact regarding deficiency in service as well as unfair trade practice on the part of Reliance Money coupled with loss on account of same.
