Dear Expert(s)
Bank filed complaint case under 138 of Negotiable Instruments Act and the branch manager filed affdavit in presummoning evidence and accused was summoned. Now after notice evidence, the branch manager has retired. Whether the present branch manager can depose in evidence instead of retired manager? Kindly guide.

Dear Sir, Is DTPC approved layout is safe to buy? Can legal heirs make claims on these properties later in case the property developer has not looked properly or the seller of the original property has not given correct information. What will happen if such litigation arise at later stage? Who has to fight in court?
When we buy these sites, what we must look for from legal aspects?

Anybody having personal knowledge can depose in evidence instead of retired manager. he must be POA for bank, authorised to depose on behalf of Bank.

Present Branch Manager can depose provided he is well aware of all the facts of the case.
