I am in the process of purchasing a Free Hold property in Delhi of which the ownership details are as under:
1)The Original owner purchased the Property from 'Rehabilitation Housing Corporation of India' in 1952 against a registered Sale Deed.
2)The original owner made a registered will in the name of his son in 1962.
3)The son got the will probated in his name in year 2000 from District Court after the death of the original owner in 1967.
4)The son sold the said property to the present owner under registered sale deed in the year 2006.
4)The present owner who wishes to sell the said property to me is now showing the original documents of the property, the original will of the first owner, the original registered sale deed agsinst which he has purchased the property and a copy of the District court probate order of the Will of the first owner.
5)The original court probate order of the Will of the first owner is not available with the current owner.
Should I go ahead with the purchase of this property.

Apply for certified copy of the Probate from court.
The title looks fine though you should check the Probate certificate.

title seems to be clear . however it is always better to get documents cross checked by a local lawyer . ask for certified copy of probate . also cross check whether property taxes have been paid till date
