Compromise decree

(Querist) 12 March 2012 This query is : Resolved 
suit filed against 2 defendats...2 was made proforma def...........one of the pro.forma def. admitted the plaintiff case.........another one filed ws supproting the defendant no. 1 & 2 possession over the suit land..........now there is a compromise between the plaintiff and the defendant 1 & 2...whether presence of proforma defendat no. 3 & 4 is necessary to the compromise agreement? help me with case laws.......

since no reliefs had been claimed against prforma defendant presence not necessary . consent terms are ebtween plaintiff and defendant no 1 ands 2

No,presence of defendent no 3& 4 are not necessary as no relief against them has been sought by plaintiff.
