Yes. The case may be seized for involving with that said offence.. After enquiry you can file a petition for return of property. Till the end of that case you can't sale the said car.

My query is whether the fine can be imposed instead of confiscation?

Not necessarily be confiscated. However, the car can be impounded till fine, if imposed, is paid.
