Consume complain-

Dear Sir
I have brought a Wrist watch from ebay and when received the same was not operation i file a complain with e bay they said it is in warranty and even the seller contacted and said to check the battery

Hence i visited a watch shop to get the battery changed, but the shopkeep said that the watch is defective and also the battery in dead

hence i ask ebay to replace the watch but twice they rejected the claim saying this is under warranty

hence i need guidance to file a complain against ebay and the seller as the watch was delivered nonoperational

Did you record the call asking you to replace the battery locally from anyone?
The battery is to be replaced by seller/manufacture....after due test.
It can not be tested on phone.

You could have avoided the product to be opened by unauthorized person.

You could have transacted in writing.

you are correct, but the fact that he watch was dead hence it was presumed that the batter was not operational hence i what to change and close the issue , as confirmed by the seller

Have you got the documents of purchase with you?
How much did you pay for the watch?
Have you given written complaint to the seller? If not, it will be very difficult for you to prove that the Seller has failed to the defective watch.

Dear sir

The watch cost is Rs 1255 +90 courier cost and was brought through ebay hence still now all communication are done through ebay and date of invoice is 31/10/2017

Hence would kindly request to guide

Take a print of the communication and bills and lodge a complaint before Consumer Disputes Redressal Forum.
It would be better if you may seek services of a local lawyer.
