Sir , I hv bought a LED . I given the model no of ONIDA LED tv to my known from where I m buying the electronics goods all the times. The cost of Onida asked from other shop was 25000. My known shopkeeper was not a dealer of Onida but he asked me that he will arrange for the same @ less price. He took the money of 9000 and for rest he swipe my bajaj card and filled the form and taken my sign on that along with a blank cancelled cheque for ECS of EMI to bajaj finance. On delivery I found that it was a 3 D of Videocon and I approached to shop for wrong item delivery . He asked me to watch for some days I am arranging the said ONIDA LED. 2 day after I got a confirmation call of buying Philips LED finance. I again appriched to shop and he told me that this is our internal with bajaj so no worry abt that. Now after 20 days I am unable to get my selected LED. Now I come to know that the 3D whixh is sent to me is costing me 38000. By which my budget is disturbed. Now dealer is asking that he will not change as he has sent all formalities to Bajaj finance and on good faith I hv signed all papers. Kindly advise me how I can come out from this trap . If I will stop the bajaj EMI then I will become defaulter for all banks . Can i apprpach to Bajaj that wrong information is given to him. Kindly advise me how I can get my selected LED legaly.

from your query it appears that you did not check the price of new set before closing the revised deal. You appear to be liable to pay.

on basis of what you have stated it appears you have been grossly negligent . you have signed the form paid advance amount of rs 9000 and furnished 3 blank cheques . you have no case

Lodge FIR for cheating. If police does not lodge FIR contact a lawyer and file criminal complaint u/s 156(3).

All depends on whether you have got a receipt for cash you paid.
If so let us know the contents of the receipt as to why you paid money.

Dear Sir , I have paid only one cancelled cheque for finance of Onida LED TV . 9000 Paid advance for 4 advance installments . On that day there was b'day of my son so I was willing to buy on that day. I was abt to go on orther shop. But due to relation with shopkeeper he said today he will send the vidocon and later he will replace it with Onida . Now for Onida I have to give the one cheque . Bill is not received by me till date. Later I got the call from Bajaj Fin that I have financed for philips LED . When I approach to Shop keeper, why he has given the wrong detail , he said this their internal with Bajaj . I come to know that I will have to pay 12 EMIs instead of 8 of Rs 2167/- . No doubt this my negleciency to check the each and every terms and condition which I have singned but normally all consumers are singning without reading just on good faith which become problem for me. I know I should signed after reading but mistake has happen . now need ur advise to come out from this problem

All your grievances are told oraly to your shop keeper with whom you had faith.Write to him and also to Bajaj finance putting facts.After all you did not get the TV without paying money but you are asking only for the model that you wanted.
In case you do not get reply you can apprach local police station with your case. Some Police stations book such cases under "social service" category,invite the parties to station, hear them and solve the problem.

In my opinion, if you have any document on record that you booked for the Onida LED TV and paid some amount for the same, you can approach the Consumer Forum.
Even no need to engage an advocate if you can plead your case by stating full facts.

If you have booked onida TV, what made you take Videocon home? If you have taken the brand new videocon home, by the time you return it, will it not become a second hand item?, there is some fault on your side which you are not expressing it openly but want suggestion to cover up your side fault(?), if you are very sure that you booked onida and have been wrongly delivered with videocon, you may take up the matter with the consumer forum for redressing your grievance.
