At the time of selling a Plasma Telivision set, the dealer of a reputed company Verbaly explaind that the model, which he suggests is havig a newer/latest technology panel having a (NEO PDP) panel instead of the older Plasma panel.
The Set is covered under three years (03)warranty.
whereas on getting the delivery it was noticed that no where it was mentioned that it is a (NEO PDP) panel set. and the warranty card supplied along with the set is for one year only.
On making the complaint to the Dealer and the company they refused and did't responded save & except the company has admitted that it's a non NEO PDP set.
Can I compell the company to change the set with a NEO PDP model set? if yes how?

Give them a legal notice to change the set with a NEO PDP model set, as the one which they provided is not as per their description & the one you agreed upon to purchase. If they don't comply, then file a complaint in the district consumer forum.

Ad Archana is quite right. I hope company will provide you relief to save the good will of company. Otherwise you have option of consumer forum.

Send them a legal notice to change the set it they refuse then file a complaint in the consumer forum.

A purchaser is required to be more vigilant and law cannot help those persons who remain silent/unvigilant at the appropriate time. What were you doing at the time of its purchase? Why didn't you noticed its name and warranty card when it was being given to you. Why didn't you demanded the assurances in writing?
All these questions are very vital and you have no reply against them except that you blindly believed on the oral assurance. So no consumer complaint lies except as covered under warranty card.
You can file a criminal case either FIR pr criminal complaint for making fraud with you (under section 420 IPC) after serving a due legal notice stating clearly therein that the dealer has cheated you.

Subject Query regarding Panasonic TH-42 PV 80D
I have purchased The above model Television from your dealer at Kolkata ,M/s Harmony House ,Park Street Kolkata,West Bengal on 11/10/2009.
At the time of purchase the dealer sold me the television set stating that the model i.e. TH-42 PV80D being " A NEO PDP " panel.set.
On getting the delivery of the product I noticed certain anomalies as follows :
1) No where either on the manual ,packing box or on the product itself was mentioned that the product is A NEO PDP model.
2) The dealer has assured that the product carries a warranty of 3 years ,but the warranty card supplied with the product has no where mentioned of the 3 years warranty ,instead the card states a 1 year warranty coverage .
3)The set which I received from the dealer had neither any protective film coverage on the side panels (Which ensures that its sealed pack set)nor any other sticker of the manufacture was their on the set whereas the set on display at the dealer point had protective film on the television panels along with other company stickers on the same.
4) The date/month of import of the set as mentioned on the cartoo box of the set is DECEMBER 2008.
5) above and all the cartoon box containing the above set delivered to me was not in sealed pack condition.which further cements my doubt that the set sold and delivered to me is of a very old model( obsolete technology) ,inferior quality and an old/used set.
In light of the above please reply to my query to clear my doubts, take all the corrective measures to redress my grievances and replace the set or else I will be compelled to initiate legal proceeding against the dealer and the manufacturer.

I appreciate the response from your office and deputing Mr Barun Dey to resolve the issue raised by me but with very much regret I have to write you, that No positive response from .Mr Barun Dey has come to me to resolve my grievances related to the captioned matter .
Earlier he took a stand that the Model 42 PV 80 D sold to me by the Dealer M/s Harmony House Kolkata, as a Neo PDP Model is a NEO PDP Model but later on he backtracked from his own stand and accepted the fact that the model 42 PV 80 D is a non NEO PDP model. and on my insisting to give me in writting his stand or else replace my set with a NEO PDP Model.he has not responded till writting this mail to you.
I once again request you to look into the matter seriously to redress my grievances, failing which I will be compelled to knock the doors of Consumer Forum and flash the story before the Media, which may not be in the best interest and reputation of Panasonic India Ltd.

I still cannot belive how a Company like Panasonic can involve it self in such a wrong act of selling its inferior/ obselete technology product on the false promise of giving Latest/newest technology product. It is against all the ethics of accepted business practice and against the reputation of your Company.
Please let me know, what action you are going to take to redress my grivances?so that all my faith in you (Panasonic india Ltd.) remains intect,stoping me from taking this matter any further.
