Contract employment of an expatriate in a foreign subsidiary in india

an expatriate employed on contract with a subsidiary of a foreign company in india with condition that legal actions can be proceeded on such employment contract only in the foreign country. the expat was contracted -engaged for a period of three years wef july 2010 but terminated in may 2011. Can he proceed against this indian subsidiary of the foreign company in Indian Courts?Pl advise. Thanks.

You should not feel hesitant. Since you live in India, worked in a place in India, so on your part you must try to lodge a case in an Indian court. If the court admits your case, the company per force would have to attend the case in India.
