Hello, may I know whether a contractual appointment letter issued on date 1/1/11 for 11 months ends on 30/11/11, be renewed on 1/12/11 or a fresh contract to be done ? the immidiate date of fresh order will effect the candidate as continious service or not ? Please give me more details if you have. Mamta

A freash agreement should be made,if there is no provision in previous agreement that same will be continued automaticaly.

Yes. The fresh agreement only can be here.. Its can't be treated as continuation of earlier service. For that purpose only earlier agreement was just for 11 months.

Contractual employees do not get benefits of continuous service.But continuing them as such against permanent jobs for long periods tantamount to unfair labour practice.

The contract appointment letter issued on date 1/1/11 for 11 months ends on 30/11/11.
As the term of the contract is over, a fresh contract for another specified term should be entered. This does not amount to continuous service.

This cannot be regarded as continuation of service s fresh agreement to be executed shall take effect from nex dte of hearing without mentioning earlier service.
