cheque bounce

Wht is the time limit of file a case regarding cheque bounce?

Dear Vijay

According to S 138 (b)The payee or the holder induce course of the cheque, as the case may be, makes a demand for the payment of the said amount of money by giving a notice, in writing, to the drawer, of the cheque, within Thirty days of the receipt of information by him from the bank regarding the return of the cheques as unpaid, and....

Incase, the drawer fails to pay the money within the stipulated period, then you can file a civil suit and criminal case.

time limitation to file complainant.
1. Within one month notice will have to be issued after receipt of the memo from the bank regarding bounced cheque.
2. 15 days time is mandatory to pay the cheque amount.
3. U will have to file a complainant within one month, after expiry of 15 days time given to make the payment of the cheque.

within 30 days after expiry of 15 days from date of reciept of notice by drawer .in other words, simply it can be calculated as 45 days from the date of reciept of notice.

cheque must be filed in to the bank within six months of issueing cheque.
when you received bank report of cheque bounce sand a legal notice regarding total facts (why you received that cheque from the party and so on)with in one month.
in that you give fifteen days time to recover the said amount.
when opposit party is unable to pay then file the suit u/s-138&142 n.i.act.
(when you move the cheque in to the bank take the slip,when bank sand you the cheque bounce information take all doc. from bank and 2nd copy of legal notice with ragistry recipt and a.d. )these are the essensial part of n.i.act suit.and there must be a reason to take that ammount
