Crpc 125 cross exam

(Querist) 30 January 2013 This query is : Resolved
My wife filed false case to distance me as she &the three daughters( all major now)o to lead a free life without any discipline and her elder sisters husband stands instrumental.

now I would like to cross more personally to bring out the truth. And his eldest brother is aware of and stands with the entire truth. he may not come on his own as a witness but if called, mostly spell out truth

May I ask the judge to be present when I cross her and may ask the advocates to be away?
May I ask the court to call her brother as a witness?

no cross can be done without presence of her advocate . you cant dictate terms to the court . you can if you so desire examine her brother as witness .

It is fundamental law that the cross examination should be done in the presence of both sides advocate in any matter.
Feel free to call

I mean not to dictate court but with acceptance of the wife petitioner cross exam her as the topics will be more personal. she may also agree for that

to call her brother as a witness do I have to submit an application or to request orally ?. I have a lawyer but I want to ask her all true questions. And I do not mind to pay her any maintenance on the merits of the case.I am prepared to pay out of my income and by disposing assets too if required as I earned only for them.

you have to submit application to the court . court will after condisering your wfife allow or reject your application
