Sir my father was ex service man. Govt alloted 3acres land to him in 1999. But my uncle registered the land forcefully from my mother in 2005. But pass books were on my mothers name.and in 2011 my mother got compensation amount in 2011 from govt as the govt had taken 110cents land for road in our land for dump yard . We are 2 sisters. And we did not signed in the registration documents. My uncle got pass books in 2017. How should we proceed to get back our land.

In ex-service man quota, the Govt. sanctioned D-Patta land to your father. There are some conditions when a land is given to freedom fighters/ex-service men etc. with some conditions. No D-Patta holder can transfer his rights to any one unless a permission is issued by the District Collector concerned. The District Collector may give permission only after expiry of 10 years (this is vary one state to another state). If the patta holder dies, the legal heirs may request the District Collector through the Tahsildar concerned to enjoy the land given to their deceased person by the Govt. so the deed executed by your mother in favour of your uncle is contrary to the conditions of the D-patta holder.
