Hi
I was a customer for Vodafone but cancelled my line due months ago and cleared my outstanding.
Recently i recieved mail asking me to clear my outstanding else criminal proceedings shall be taken against me.
Can i file defamation suit against vodafone?
They have not yet made extra payment that i made before line closure.
Please suggest

You can seek damages for wrong notice on account of harassment and agony preferably before forum; but suit for defamation is not attracted on facts stated as the notice of demand has been personally served on you which does not amount to either defamation or its publication. Moreover a suit for defamation is always a weak suit and a too much time taker for negative result percentile more higher than positive.

I do agree with prabhakar singh and add that threatening of vodafone to initiate criminal action against you is unheard in such matters so a suitable reply may be given accordingly.

if you file a suitfor damages it will take 20 years for suit to be disposed of . in addtion you will have to pay court fees on amount claimed plus lawyer fees.
be practical . send reply to vodafone informing me them that you have cleared all payments . enclose proof of payment made namely cheque no by which payment made etc.

Sorry boss, u can't sue him on the ground of Defamation as notice/mail is served on you personally. it doesn't amount to Defamation.

Since this is an Email message and it has not been made public, you can not go for Defamation. The right way is to knock the door of Consumer Forum.
