Defaulter in a co p hsg society

(Querist) 05 December 2014 This query is : Resolved 
In our housing society in Mumbai the dues(nearly forty thousand rupees)of a defaulted member was written off as bad debt.Now this defaulter member was co opted in the managing committee and became Chairman.
Please advise is it acceptable?
Does the defaulter nature is removed along with the writting off and the defaulted member can become a managing committee member.

why was it written off ? you should taken recovery proceedings under section 101 of MCS Act . a defaulter cannot be member of MC .

A defaulter can not become member of managing committee in the society. Lodge complaint to registrar of societies.

1. IF the "defaulter's dues" were duly written off and approved in any General Body meeting (AGM/SGM), and further reflected in the Society's Balance Sheet, THEN the said member thenceforth CANNOT be classified as a "defaulter", and CONSEQUNTLY THEN can be lawfully coopted in the Mg.Committee.
