Difference between rcop(rent control act) and eviction suit

Sir,

1. What is the law available to vacte the tenant, if the property is in small town or panchayat(Tamilnadu).
2. What is the difference between RCOP and eviction suit?
3. What will be the approximate difference in time duration between RCOP and eviction suit?

A tenant can be evicted under Transfer of Property Act. But to protect interest of tenants, rent control and eviction act is applicable in some part of state. mostly in panchayats and small village this act is not applicable. I am not knowing what is law in TN but i think your case comes under TP act and you can evict tenant by force of notice given by you. you should contact a local civil lawyer.
