Difference between revenue stamp and non judicial stamp and judicial stamp

DEAR EXPERTS,
GENERALLY WE USE THE NON JUDICIAL STAMP PAPER TO RECORD ANY DEALS, AGREEMENTS ETC. WE ALSO USE REVENUE STAMP FOR AFFIXING ON RECEIPTS SHOWING THE PAYMENT OF AMOUNTS COVERED BY THE AGREEMENT. BUT WHAT ABOUT THE JUDICIAL STAMP IS AND WHERE IT IS USED PLEASE EXPLAIN. SECONDLY IS IT NECCESSARY TO SIGN ACROSS THE REVENUE STAMP OR IS IT SUFFICIENT IF AFFIXED IN THE TOP OR BOTTOM OF THE RECEIPT? THANK YOU.

THANK YOU SIR, BUT PLEASE ANSWER MY QUERY WHETHER SIGNATURE ACROSS THE REVENUE STAMP IS MUST OR JUST AFFIXING IT ANY WHERE ON THE RECEIPT AND STRIKING A LINE ACROSS IT IS ENOUGH COMPLIANCE.

Incase the receiptient is physically present then signature across the stamp is required, however, in case of unforeseen circumstances like non availability of stamps etc.. a cancellation on the stamp is sufficient.

Read Section 12 of Indian Stamp Act:-
12. Cancellation of adhesive stamps (1) (a) Whoever affixes any adhesive stamp to any
instrument chargeable with duty which has been executed by any person shall, when affixingsuch stamp, cancel the same so that it cannot be used again; and
(b) whoever executes any instrument on any paper bearing an adhesive stamp shall, at the time of execution unless such stamp has been already cancelled in manner aforesaid, cancel the same so that it cannot be used again.
(2) Any instrument bearing an adhesive stamp which has not been cancelled so that it cannot beused again, shall, so far as such stamp is concerned, be deemed to be unstamped The person required by sub-section (1) to cancel an adhesive stamp may cancel it by writing on or across the stamp his name or initials or the name or initials of his firm with the true date of his so writing, or in any other effectual manner.

Yes thank you, but you see sir jee the advocates BAAT KI KHAAL NIKAALTE HAIN NAA so I wanted to know as in one transaction the receipt was executed on plain paper as there was no revenue stamp available. Now the person in whose favour it is executed wants to affix the adhesive stamp. That was the reason for my asking in detail. Now what I gathered is stamp can be affixed now and crossing across it with the pen mark will suffice the matter. Thank you very much Shailesh Jee

Querist! It is a matter of common sense that adhesive stamp is required to be crossed by signature and merely its affixing over the paper is not sufficient and no meaning can be got derived that the signature were obtained over the actual receipt. It authorizes the document as true only when the stamp is duly signed by its issuer.
