Where to file petition of discharge of case. In district court or high court
Isaac Gabriel (Expert) 14 November 2020
What is the case? State the case stage and why you prefer to discharge?
Dr J C Vashista (Expert) 15 November 2020
Mr. / Ms. Anonymous,
You have concealed facts of the case and your identity, therefore no obligation can be extended.

Please state clear material facts / discuss with local lawyer after showing him all related documents.

Discharge of an accused can be ordered by the court that is expected to frame charges against the accused and it occurs just before the court frames the charges. It is conceptually the just opposite or antithesis of the process of charge framing.

To get a discharge it is not very essential to file a separate petition as discharge can be argued on the day of framing of charge. But if the accused is so confident that there is no accusation of substance he/she can file a petition for discharge.

Anyway, a write up that answers to some of the common questions on the subject by me is available for further reading at https://www.lawwatch.in/2020/03/14/Discharge%20/

Deleted this one, so as to avoid the unintended display of above message, after I got the error message for the first one.

This is in fact a problem that occurs many a time and the site administrator has to correct it.

That is why queries are repeated by many querists. Providing a delete button for the author of a post is one mechanism to solve the issue.

Site Administrators have nothing to do with your Mistakes of Pressing the Button " Submit " more than Once and Mr.Rajendra K Goyal who is the most Senior should not claim as Innocent and Intentionally he is doing it to increase his Points of Hall Of Fame

The problem I raised is a real problem. One cannot see such a problem in any website of this magnitude.

The problem is that when you press Submit” button you get an error message indicating that the message has not been posted but erred in the process.

Then you naturally submit the same message for the second or third or more times all of which result in error messages. After sometime you may find that all the messages which resulted in error messages are posted properly. This problem is frequently occurring on this site particularly when the connection is a bit slow.

I pointed this mainly because I know website technologies very well and have been maintaining some websites in the past and one on law www.lawwatch.in now also by myself.

Another reason is that I have seen some people, probably out of their ignorance of technologies or inherent interest in trampling upon people unnecessarily, bashing on the hapless querists who get trapped in such problems. Even I am not spared.

This multiple posting problem is not there on Live Law site. If you press submit for the second time without any change in message, you will get a message that it has already been posted.
