I am not getting why the case is still in mediation cell when I am not appearing in mediation cell dates. Why mediation cell is giving date after date? When will my case get offically withdraw/dismiss?
How many years it take in Indian Courts to withdraw a divorce case in mediation center of court?
Guest (Querist) 09 April 2013
I came to know that if I do not attend mediation center for 90 days the case will go to court. Even though my wife is attending mediation center on each date.
Experts please give enlightenment.
Adv k . mahesh (Expert) 09 April 2013
you should have asked your lawyer why taking date every time tell him to withdraw
Guest (Querist) 09 April 2013
I asked him he said case will go to court after mediation center people send it to court.
Devajyoti Barman (Expert) 09 April 2013
You file a withdrawal petition in the court itself for dismissal of the case on non prosecution.
If judge does not agree then participate in mediation and get the case sent to judge so you can move withdrawal petition.

It sounds really weird that mediation is still going on when you have filed withdrawal petition.
Ask your advocate not to attend the case any more.
Guest (Querist) 11 April 2013
Will case close if my advocate and me did not attend the case?
ajay sethi (Expert) 11 April 2013
