Divorce

(Querist) 24 May 2012 This query is : Resolved
Hello sir,

Me and my wife have been seperaetly living for last 2 years and also have son of 8 years old . We both filed for divorce mutually and is now nearer to the final hearing. However afetr a lot of thaught and discussions , we decided to give one last try to get back together.

My questionn is: While we try out for six months and then let the court know if we could withdraw the case or goahead with the divorce verdict.
Adv. Chandrasekhar (Expert) 24 May 2012
yes. you can give a try for six months. The time given to estranged couple in mutual consent case is 18 months. In 18 months, they can withdraw the petition or go ahead with the divorce.

NO PROBLEM:
You start residing together and resume cohabitation.
You can withdraw the petition, if decide to live together.

You can as well file 13b again, if you miss the 18 months period.
