Divorce after 2 yrs of separation

Hi,


People please guide me.

I have been separated since 2 years and the divorce case is also pending for almost 2 years.

My lawyer says that 1st the maintenance needs to be declared by the court before any decision can be made by the court on DIVORCE ?

Lawyer says that settling the issue by meeting the other party's demands is the quick thing of getting divorce.

ELSE there is wait for atleast another 2-3 years

Is this true ?

Settlement is always a better option. Contesting a case can be a long wait as you are advised by your lawyer.

My Ex is not ready to sign !

Needs huge settlement money and a 2 BHK Flat in Mumbai.

What's the remedy ?

In that case, contesting the case on its merit is the only remedy. Consult another competent lawyer in your locality or someone who is specialized in family/divorce cases.

Divorce and maintenance can be decided together or separately varies on case to case , all other issues raised by u are to addressed after knowing the facts

Interim maintenance pending Litigation will be decided first. Contested div petition will take abt 2 years ; So your Adv correctly guided you. Go for MCD.

2 bedroom flat in mumbai . means a crore .plus she wants huge settlement money .

you must be doing very well finacially for your wife to make such demands .

continue fighting the caseif you are unable to meet the demands

If demands of your wife are not consistent with your economical status then better to get the case decided on merits may it take some more time.
