Hi I'm roby. I was married and got a daughter of 12 yrs old. Marriage life was such a nightmare . She is a working woman and we always had a dispute almost everyday. We lived in our own house . My parents was sent out from home and I was not allowed to speak with them aswell.. I had lot of restriction and in every fight , she throws Thali and moves out to their parents home in Hyderabad . I was constantly going and pleading to her to sustain the relationship. We stayed in different bedroom in same house.I was diagnosed with severe sleep apnea during the same time. I was left helpless during my bad days. My parents stayed out of my life as she blackmailed with divorse me if I contact my parents. She had contact with one of her relative . She will b either on call or texting him. His wife came to our house with the phone bill proof and shouted at my wife for speaking with her husband. My wife rudely told her that she will not stop talking to him and do whatever she wishes. When I asked , she threw thali onto my face , tore wedding Saree and went to her parents home. After many years of pleading , I filed divorse case . She said that she is not ready to live with me and at the same time, she cannot grant divorce. Its been 7 years since we got separated. After 4 years of case, court dismissed the case.
She took all the documents from home when she left along with lic bond. With the same lic agent , she changed lic owner from my name to her name by forgering my sign nd provided Xerox of my proof. She erased all the proof from my email where I had the phone bills of her. As she is woman , nd in the name of my daughter , she is playing wisely as the law , court judge favouring her.
I filed case in high court now. I'm from Chennai and she is Hyderabad. Every time I have to travel to Hyderabad. I have sleep apnea and had heart attack because of that but court is not ready to understand in spite of providing all reports.
I was not allowed to meet my daughter.. last time whe� i met her, she asked if im not dead ? Coz her mother told her that am dead. I was all alone for 7 years... I'm 37 years and now I married a girl and she is pregnant. She knew everything about me and taking care of me so well. She also willingly send money to my daughter and also request me to give the only home i own to my daughter. Im happy and peaceful with my second wife. My only concern is my first wife is not giving divorce.. I really don't know what she would do if she comes to know about my remarriage.. there is already maintainance case going on for Rs. 35000 instead of Rs 7500. Kindly suggest as what can be done. Can she file DV case ? I did not register my second marriage. I added Nick name along with my first name in wedding invitation. Wedding pictures are safe . I also thought of absconding . Please help.

When, Mr. Kumar Doab, a fake expert with unreal name, considers that "you can benefit from the psot of Mr. P. Venu, you would be justified to ask him for what purpose he wants your ID.
Even otherwise also, when you have stated, " My only concern is my first wife is not giving divorce.. I really don't know what she would do if she comes to know about my remarriage.. there is already maintainance case going on for Rs. 35000 instead of Rs 7500. KINDLY SUGGEST AS WHAT CAN BE DONE. CAN SHE FILE DV CASE?" you would be justified to ask Mr. Kumar Doab, in what way you can benefit from the post of Mr. P. Venu, when he has merely declared your marriage as illegal, but not suggested you what to do?

Absolutely wrong and irrelevant advice of Mr. P. Venu and Ms. Usha Kapoor, when you have not asked the status of your marriage with some other girl, which you have already made without getting divorce from your first wife. None of them have replied your question, what can be done?
Can they suggest you to leave your second wife, if 2nd marriage is unlawful or illegal?

Artificiality seems more than reality in your description. However, nothing can be said, what your wife would do, if she knows about your marriage with another girl, when she is not ready to give divorce to you. Nobody can anticipate about her thinking about your remarriage and what she would like to do after knowing the incidence. You can enjoy your 2nd marriage till anybody gets some order from the court of law on that issue.
About your ailments of sleep apnea or the heart attack, the court has nothing to do with that, so far as justice or their legal duties & responsibilities are concerned. The court is not expected to take any lenient view on account of your diseases, so far their legal responsibilities are concerned.

If I have pointed out on what your advice lacked in and on what issue you could have suggested some solution, that should be sufficient for you to understand what to do, whether to supplement or amend your already give advice. The querist has not asked you whether his 2nd marriage was lawful or unlawful. As an expert, you should have known that every layman commits one or the other unlawful activity due being unaware of the provisions of laws of the land. That does not mean you keep your statement (not even advice) restricted only to pin point that activity. As an expert, you were expected to suggest some solution to the problem, may that event be lawful or unlawful. If you were unable to provide any solution, where was the need merely to add more worries to the already suffering fellow with heart disease and sleep apnea?

The second marriage contracted during the subsistence of marriage is null an void and illegal in the eyes of law and also punishable under section 494 IPC if the aggrieved party or her parents report this matter in a private criminal complaint before the concerned judicial magistrate court, until your personal law allows this privilege of marrying another women during the subsistence of your marriage.
If you are not a Muslim by religion then you may face the danger of being booked under bigamy.
If she files DV case then you can challenge the same on the basis of the long period of gap between you both as a reason for her false case.
If you feel that you want your child back, you can file a child custody case.

Mr. T.Kalaiselvan The Law of Bigamy is NOT applicable to Live - In Relationship as there is no Legally contracted Marriage.. In order to prove Offence of Bigamy there should be ample proof/evidence that they had done a second marriage with out nullifying the first marriage.

Mr. NJS Rajkumar always harps some different tune than the law prescribes and even against the facts of the query. it seems he has not read the statement of the querist, where he stated, "I married a girl and she is pregnant".

@T . kalaiselvan : i did marry a girl . But they would need a strong proof like photographs , wedding card etc which Is safe as I already mentioned. There is no connect between me and her except the money transaction I do for my daughter . Is there any time period of seperation after which I can get divorse ? Divorse case was filed in 2014.
Description might seem artificial for few as I cannot my complete history here. Just a short description though ! My first wife was not with me when I was in hospital bed and was left to die.. everyone including my parents only concerned about the money that I earn and hold . When I had no one to take care of me and when everyone were behind money , only this girl were with me running and taking care of me in hospital. She did everything without expecting anything in return. I'm legally bonded to someone who don't deserve or value relationship when the truly deserving is just calm hiding back. Fed up with the law favouring women and the status of men !! Kindly suggest if I had to wait or abscond if that would help !!

I have sleep apnea and so I snore too much and cannot survive without a cpap machine . I cannot use that machine in train or flight and so I have hard time travelling. I was asked to get down from bus as my snoring sound was too much and co passengers could not sleep. More than money , these are stressing me out !! Kindly do suggest as what can be done.

I gave my debit card, credit card etc as she suspected that I would give money to my parents. The only proof is her phone bill which would be sent to my email id every month for me to pay . However , as she too knew my password , she cleared everything when this was broughtforth in court. Even i didnot pay attention to gather all these proof as i was not intended to prove nd get divorse . I was living all alone living life as it went . Now getting married , i have some purpose in life and It's impossible for me to get her phone bill now. May be the fate of the husband who married such a woman should be left alone to be dead or arrested for getting remarried !!
