Divorce on the ground adultry

(Querist) 10 June 2012 This query is : Resolved
I am a Hindu and my wife is also is a Hindu. Can I get the divorce based on the DNA test Report which concludes that the baby born is not mine? or any other evidence is required?
If that is enough, how much time it may take to grant me the divorce decree?
Devajyoti Barman (Expert) 10 June 2012
Yes this is enough ground to prove her infidelity and the cruelty to you.

1. DNA report Proves Adultery conclusively.
2. How Much time ? Court suits take a long my friend.

DNA test report can confirm the act of Adultery.
Dr V. Nageswara Rao (Expert) 11 June 2012
1. Has DNA test been conducted already and how and at whose instance?
2. Did you file the divorce suit already?
3. Or are you intending to file a divorce suit and ask for DNA test?
4. If you have the DNA report already with you, that will be clinching evidence of adultery if the conception has taken place after your marriage.
5. If the pregnancy has taken plcae BEFORE your marriage and the delivery of a fully grown baby has taken place after the marriage, the ground of divorce under HM Act will not be adultery but premarital pregnancy.

First get DNA test done on your own then only give the report in court with petition for divorce on the grounds of adultery.

Sir,
DNA test was already done at my instance after signing a notarized bond by both of us to entitle to file a suit basing on the Report and she conceived after 7 months of marriage. Going to file a suit soon.
I have one more question, kindly reply that whether I have to prove the person with whom she got the pregnancy? or is it sufficient to prove that during the month she conceived, she telephoned to a phone number several times during night times at 11pm, 2am, 4am etc.
