domestic violence

(Querist) 21 July 2016 This query is : Resolved
My one neighbour 50 yrs. widow is suffering from domestic violence by her in law since long. Her husband died leaving 03 daughters, 15 yrs ago. Under that circumstance to have family support for sake of her three daughters she started living with her in laws and under compulsion she also handed over whatever movable and immovable property she had to her younger brother in law. Who sold her property subsequently. Now her all daughters have been married and her younger brother in law also got married. Now problems is that her younger brother in law do not want her stay with them. she is being thrown out from house by her in law to live with married daughters now. Day and night they are quareling. She do not want to live with married daughters and reluctant to tell the fact to them for the sake of her dignity. Most often I have given shelter to her. She is making mind for legal fight. Is there any legal remedies available for her.

Since her proprieties are long sold she can not claim back the same.
The brother in law has no legal obligation to maintain sister in law.
The daughters having been married they can neither be held responsible to maintain their mother legally.
Now only option is to seek shelter in old age home.

She had been thrown out from house so she lodged fir with local police who advised to her in law to settle the matter peacefully within family members. Now it came to light that the plot on which her younger brother constructed house is actually belong to pwd department of west Bengal which had been allotted to her father in law in leasse . there was some plots at their native village in u.p in the name of her father in law but that have been sold by her brothers in law and amount was distributed among her brothers in law and mother in law but she did not get her share and this transactions were kept secret. She has been shifted to old age home. But she want legal action and donate her share of property to old age home. Is there any chance for recovery of her property legally.
