Domestic Violence Complaint

(Querist) 02 June 2010 This query is : Resolved
I have lodged a formal written complaint of Domestic Violence to Local PS against my Husband. Police took no action.
Shall I proceed to PO with the same written complaint?
Please tell me what I have to do if I approach PO?
Is there any benifit of approaching PO without going to court?
Ruchi Gupta (Expert) 02 June 2010
u can approach the SHO OF PO, iF HE IS also not listening then file a complaint in the court.

Police has nothing to do in the present matter. You should approach to Protection Officer and then to concerned criminal court.

There will be an officer in every Police Station called Station House Officer, you need to approach him only

The best method for you is to prepare application under Sectin 12 of the Act and file it before the Metropolitan Magistrate along with the copies of complaint you have already filed before the police station. Then the concerned magistrate will take all the needful action. The Act has given the option to the aggrieved person to approach (1) police station (2) service provider (3) protection officer or DIRECTLY THE AREA METROPOLITAN MAGISTRATE'S COURT. The experience says that the fourth option is always beneficial to the aggrieved person.

It is better to file before Magistrate Court.
