Doubts regarding coop, hsg soc rules.

My name is Govind Vasant Naik, resident of Dombivali, Mumbai, Maharashtra.

I stay at ground floor in Coop. Hsg. Soc. Named Om Durga CHS in dombivali, District thane, Maharashtra. We are staying there for last 32 years.

My flats have windows and balconies facing the backside of the building, beyond which lies the Central Railway tracks. We have placed few pots and plants near the fence wall. That typical area doesn't have any pathway or disturbance or nuisance to anybody as nobody from the building roams there. We take care that we keep that area as clean and pleasant as possible, because our own windows and balconies open there. Having plants over there certainly doesn't cause any sort of physical obstructions or nuisance to any member of the society.

But, suddenly, some of the members are complaining that having pots in the society is illegal and want to remove them.

Honestly, i want to know, is it really illegal to have pots in society even if they are not causing any problem to any body?

Your little help and guidance in this regard, will seriously help me a lot sir.

well since the society ground forms part of common area it belongs to the society and it can frame regulations in this regard . ask the society to plant some trees near the compound wall .

wwhat office bearers and members of society must realise that it is better to coooperate for benefit of all members of society . if by planting pots you have onstructed right of way then you can be taken to task . try to obtain sipport of majority of members to your view point

I totally agree on the point to obtain support from majority of the members. But the problem is that they think and keep on saying ... it is illegal to have plant in pots inside the society premises.

I wanted to know ... is it really illegal to have plants in pots.. even if it is not obstructing anybody at all...?

Sir,

All i need to know is...Wether it is illegal have plants in pots in society.

I tried searching on the internet for it, but did not find anything in the information on bylaws of cooperative housing society.

If it not illegal, then i can try convincing other members and seek their support as you have already promptly suggested.

This is no illegal to have lants in pots as society bye-laws so do what ever you deem fit.
