Sir
my client wife left metrimony home in 8/2008 and from their parents home she filed complaint to jmfc u/s 12 of Dv act2005 demanding 18,19,20,22,23 privelages from court on 3/2009
can she eligible
Bcause she is not aggreaved,
she is not in domestic relationship
the bar of u/s 468also
sujjest me.

Yes she is prima facie aggrieved person and no bar in time is there.
It is continuing wrong.

it is necessary to go through the averments made in complaint to determine whether an offence under domestic violence act is made out

She can file as this Act is applicable with retrospective effect. You do admit sharing life with her till 2008 so no legality has been committed by her.
