DEAR SIR I HAVE ONE PROBLEM PLS GUIDE ME
ONE WIDOW WORKS IN OUR COMPANY,SHE DIED SON ABOVE 25 YEARS THAN HER SON ENTITLE FOR FAMILY PENSION, IF YESTHAN ON WHICH HEAD,,,
MEMBER HAVE NOT SUBMITTED FORM NO.2 OF EPF ACT

how is his son is eligible for family pension
as the family pension is payed to the old age dependents and unmarried daughters and if the son is physically disabled then you can pay to him
the procedure is he should provide legal heir certificate and requisite forms

If the member had not filled her form 2 as required for the nomination then this problem can be got sorted out by demanding the succession certificate from the relevant court. As EPS is to be released by EPFO then why are you woried? Forward the forms to RPFC and let them decide the entitlement.

The entitlement of the pension is to be decided on the level of Employees Fund Organization and this is not the duty of th eemployer to decide. Employer has to forward the relevant forms duly verified as per its record only.
