Eviction of tenants

(Querist) 21 August 2013 This query is : Resolved
Dear sir,
After a long court battle of 23 years family members entered in to family settlement. Settlement was decreed by hble HIGH COURT OF DELHI. As per settlement prop is to be sold with in two years and sale proceeds to be divided between 13 family members. bldg. is about 90 years old and in bed condition. buyers want vacant possession from tenants also as he will redevelop the property. no body wants to buy rented property. pl advise how to get eviction of tenants and what can be the grounds for eviction all have to purchase new accommodation after sale. Partition of property was not possible by meets and bound and the only solution was sale and purchase new property for bona-fide need The property is not in habitable condition and in any case requires rebuilding. landlords have no means of redevelopment and as such selling so that new accommodation is purchased. present accommodation is not sufficient and suitable for 13 families.
can eviction be asked under sec 14(1) e,f and g of DRCA on the basis of above circumstances.

you cant throw tenants who have been staying in building for years . if tenant fails to pay rent on time or carries out unauthorised alterations you can file suit for eviction better pay tenants compensation for vacating the premises .

You can have amicable settlement with the tenants for eviction. Legal process will take years with decision on merits (may be against you).
