Exhibition of Document

Court wrongly exhibit the Photocopy of document in the absence of opposite party & his advocate.Now the advocate moved an applicatio to de-exhibite the document.Is there any citation on this point.Plz help

sorry dear so far my knowlege is concern there is no provision for de-exhibiting the documents.

Even if any document has been exhibted wrongly or rightly, the same is now chellengeable at the final argument and under the provisions of changed CPC, courts are bound to give specific findings over the admissibility of certain document as exhibited or not. so you have lost nothing even if it has been exhibited. Withdraw application making the statement that you reserve your right to challenge it at later stage.
