Transaction in a closed bank account

Respected Lawyers,
Ref:my post on 28/10 & 30/10
As I wrote for closing my salary account
by the bank itself.The pretext used by them
for Rs.5.28 overdrawn though there was no
money transaction since four months to the
account neither by me nor by the company as
I am getting my salary by cash because of
safeguarding my hard earned money as they
have done illegal fund transfer from my salary account to a bogus credit card account. I have sent two legal notices &
now about to file a case against the said
private bank.I presume notwithstanding the
legal action by me they have done the closing without valid reason.Anyway I repeat money/any other transaction in a closed account by the bank itself is an
offence or not? if done so then what legal
action can be initiated? please advice.

Dear Anonymous,
According to me, you are on a very weak wicket. Whether you agree or not there is a dispute about overdrawn amount. You allege that they are adjusting against some bogus credit card. Do you mean to say that the credit card does not belong to you at all or the transactions done in the credit card are bogus? Thus, there is some dispute going on between you and the bank. Simply because you asked them to close the account or the bank closed the account of their own (whether legally or illegally) does not mean that whatever money comes to your account, against which the bank has according to them some outstanding balance, they cannot first credit the same to your account and then appropriate the same against their dues.
Yes, you have every right to take whatever legal action (whether civil or criminal) against the bank as you deem fit.
But, I do not think that you are on any strong wicket.
