Partition Of House

Dear Experts,

For filing suit for partition of the house in the court of law is it advisable to file in lok adalat or civil court, please inform and which one will get faster judgement.I am resident of Hyderabad city.

You cannot file the suit directly before the lok adalat.It is the civil court who has jurisdiction to listen and decide the partition suit.

Yes . However such suit could be transferred to Lok Adalat if the court thinks that the parties are ready for compromise.

Yes,directly suit for partition can not be filed in lok adalat.You will have to file the same in civil court and if both the paries and court thinks that case should be transfered to lok adalat for compromise then u/s 89 of C.P.C court can transfer it to lok adalat else it will be heared and decided by civil court.
