Dear Sirs,
I filed a divorce suit against my wife in October 2011. I have good grounds on mental cruelty being inflicted upon me. She is earning well also. She is enjoying right of residence too. But in order to harass , she is filing DV case against me after nearly 3months of the divorce case, without strict proof of physical,financial(economical)cruelty.She is getting affidavits from two or three close relations of hers that I used to beat her and that they have seen this. How can I get her DV case dismissed??? Any other advise is welcome. Any judgments of similar cases will be of great help.Notice in the DV case has not yet come. But will come soon.

Case cannot be quashed, so it is better to contest the case.

Fight the case on its merit

You have to first face trial of the case.
If you could prove that her DV case has got no merit then only it would be dismissed but that too partly as the court is likely to allow few of her claims.
