Motor cycle hit against the Electric post while its owner riding the bike.Bike is having full cover insurance .Whether owner(injured) is entitled for the compensation.If yes who are the respondents in OP?.Please reply with citation

There is no required to initially file any petition. first of all in such case, a formal intimation is required to be given to insurance company at the earliest so that a surveyor may be got appointed and his report may be got prepared.

A police report is also necessary.

Thereafter a claim should be made with the insurance company after getting the vehicle fully repaired enclosing the relevant bills and all other required information as sought.

If the claim is repudiated only then a consumer complaint is required to be filed against that insurance company. NO MACT claim petition is maintaiable in the given case.

No sir I am not inquiring about the damage caused to the Vehicle. What about the injury caused to owner of the vehicle?

Yes!Since the insurance is comprehensive,the insurer is liable to all damages to the vehicle as well as to the person of driver provided the driver/owner has a valid licence of driving.
