my father owned a property he died without a will,my family includes my mother my 2 brother and we two sister.my elder brother has a son and daughter. i want to know the right of my mother,we four brother sister and right of my brother's son ans daughter if any please guide

your brother's son and daugther have no rights in this property.if your brother is alive. the property will be divided in you mother and all of you (brothers and sisters)

Dear Trupti,
Your mother and siblings each hold the property to the tune of 1/5th each.
As regards brother's son and daughter. They hold equally with their father - as the property on inheritance becomes ancestral in their hands. They take equal shares in the property of their father i.e 1/3rd of 1/5th = 1/15th each.

आप के पिता जी की सम्पति में उनके पत्नी ,माता ,तथा पुत्रों पुत्रियों का बराबर का हिस्सा होगा और उनके पोता पोती का हक अपने पिता के हिस्सा में होगा ,न की अलग से उनका हिस्सा मिलेगा..
