Regarding constructing in an un-partitioned land.

my father expired without writing a will for his property. Now my mother brother and I have legal right over the property. My brother is making constructions in the land and is taking better portions for himself at his own will. He does not heed even if I object. Filing a partition suit is not affordable for me because the value of land is considerably high. Is there any other means by which I could prevent him from constructing before partition is made.

How has he got the plan sanctioned in his name with out your signature/consent about the land when he does not solely own the land?
However, file a declaratory suit against him alongwith a petition u/156(3) praying for ad-interim injunction against any construction on the land till the suit is didposed off.
