Land lord refuses to accept rent and not giving receipt in the name of widow after tenant's death.

Land Lord refuses to accept rent from the family of the deceased (in fact from widow of the deceased tenant)in mumbai,rent sent through post are returning back.what is the remedy?(the property is residential.).family has been staying for more than 40 years.

Let her file a case and deposit the rent in the court. Refer Bombay rent act.

If landlord refuses to receive rent despite of sending the same through post then the same shall be treated as offer on the part of the legal heirs of the deceased tenant and the landlord cannot get vacation of the property on the basis of non-payment of rent.

On refusal of the rental amount sent through money order to the owner, first send a legal notice demanding owner to furnish his bank account details so that the tenant may deposit the same to the owner's bank account directly every month, if he fails to respond to the legal notice, the tenant can approach the court (Rent Controller) to permit the tenant to deposit the monthly rental amount with the court every month thereon.

on the death of the tenant, the members of the tenant's family, who were
residing in the premises would be deemed to be tenants.the landord is bound to accept the widow as tenant under section 15 of mahrashtra rent act . if he his refusing to accept the widow as tenant she can issue legal notice to landlord to transfer tenancy in widow name . if her refuses to accept rent you can deposit rent in court .
